This contract is for the sale of goods to ______________________________ and complies with Maryland State law binding __________________________ and CCP in a contractual agreement. 

Items Purchased. CCP agrees to sell ______ (# of product) pies to _______________________ in accordance to the purchase order and in compliance to this contract.

Payment Method. Payment will be made to CCP in the amount of the invoiced ticket that is received upon delivery in accordance with the purchase order. Payment is due at the time of delivery and can be made in one of two ways: (1) cash (2) check. Any other form of payment will not be accepted.

If payment is not received at the time of delivery and the goods are still received by _______________________, then _______________________ agrees to pay 5% interest on the amount due each week that it remains unpaid.
In addition CCP holds the right to consider it a breach of this contract and may cancel any order if the payment is not paid at the time it is due. 

Warranties to be Made. CCP Warrants that its goods will not have substantial defects upon delivery. 

CCP WILL NOT BE LIABLE for any goods that are damaged after the product has been moved from the CCP’s delivery vehicle to the property of the buyer. 

Costs and Attorney’s Fees. In the event that there is a breach of contract, CCP and ______________________ agree that the winning party’s legal fees will be paid in full by the losing party. 

Choice of Law. In the event of a dispute, CCP holds that Maryland State Law will be applied in the lawsuit. 

 

Severability. CCP and ____________________ agree to permit the court to sever any invalid provisions while keeping the rest of the contract in tact. 

 

Assignment. CCP hold the right to sell their rights under the agreement to a collection agency in the event that _____________________ does not make any due payment within 90 days of the due date.

Non-Compete Agreement

This non-compete agreement is between Chrissy Davis and CCP and is made effective on the date of signature by Chrissy Davis.

Non-Compete Covenant. i, ________________ agree, after the date of signing this agreement, will not engage in any business with a competing company in a 10 mile radius either CCP storefront. 

Engaging in business includes but is not limited to, (1) owning, partnering, or being an agent for a competing company, (2) being employed by a third party that engages in competitive business

Non-Solicitation Covenant. For 6 months after I, _______________ depart from CCP for any reason, I, ________________ will not solicit or take business from CCP by providing the same or similar products to any customer of CCP. Nor will I, _____________ use any confidential information to benefit myself or a competing party.
